Personal data privacy policy
This Personal Data Privacy Policy (hereinafter referred to as the Privacy Policy) constitutes a public agreement entered into between the proprietor of the online store, Limited Liability Partnership Global Hub Solutions LLP, BIN (business identification number) 231240009268 (GHS)/Seller, and Buyer in accordance with Article 387 of the Civil Code of the Republic of Kazakhstan, pursuant to the Law of the Republic of Kazakhstan “On Personal Data and Their Protection”. It pertains to information containing personal data of Buyers, which the online store http://www.tapitap.kz (hereinafter referred to as the Online Store) may collect from Buyers while they are utilizing the Online Store website.
1. Definition of Terms
1.1. Personal Data: Information pertaining to an identifiable individual or determined based on such information, recorded on electronic, paper, and/or other tangible media.
1.2. Non-personal Data: Information automatically transmitted when the Buyer views advertising blocks and visits pages where the system's statistical script is installed, including the address of the requested page, cookie information, IP address, browser information, referrer (address of the previous page), and access time.
1.3. Collection of Personal Data: Actions aimed at obtaining personal data.
1.4. Processing of Personal Data: Actions aimed at accumulating, storing, changing, supplementing, using, distributing, depersonalizing, blocking, and destroying personal data.
1.5. Protection of Personal Data: A set of measures, including legal, organizational, and technical, carried out for the purposes established by the Law of the Republic of Kazakhstan "On Personal Data and Their Protection."
1.6. Online Store: An Internet site located on a server in Almaty and having an Internet address http://www.tapitap.kz, which presents goods offered to Buyers for placing Orders, as well as the terms of payment and delivery of these Orders to Buyers.
1.7. Website Services: All services available for use on the website http://www.tapitap.kz and its subdomains.
1.8. Buyer: User of the online store.
1.9. Seller: A legal entity or individual entrepreneur, resident or non-resident, specified as a seller when ordering goods.
1.10. Cookies: Small text files in which the browser records data from sites visited by Buyers. Cookies perform various functions, such as facilitating efficient navigation between pages, remembering preferences, and improving the overall experience of interacting with the Internet site. They also help ensure that the advertising a Buyer sees online is relevant to their interests. Failure to use cookies would make it impossible to purchase goods in the online store, as the entire operation of the shopping cart relies on saving data from these files. For example, if a Buyer selects a product, adds it to the cart, and moves to a new page, that product will not be saved in the cart without cookies.
1.11. IP Address: A unique network address of a node in a computer network built using the IP protocol, allowing the location of the Buyer to be determined. The online store does not track location beyond city and region.
2. Subject of the privacy policy
2.1. This Privacy Policy delineates the responsibilities of GHS/Seller to maintain confidentiality and establish a framework for safeguarding the personal data provided by the Buyer upon registration on the online store website and/or when placing an order to purchase goods.
2.2. The personal data permissible for processing under this Privacy Policy is provided by the Buyer through completion of the registration form on the online store website and includes the following information:
2.2.1. Buyer's surname, first name, and optional patronymic;
2.2.2. Buyer's contact phone number;
2.2.3. Email address (e-mail);
2.2.4. Delivery address of the product.
2.3. Any additional personal information not listed above (such as purchase history, browsers and operating systems used, etc.) is also subject to secure storage and non-disclosure, except in cases outlined in clause 4.3.2. and clause 4.4. of this Privacy Policy.
3. Objectives of Personal Data Collection and Processing for Buyers
3.1. The Seller collects, processes, and retains only the personal data necessary for providing Services and/or facilitating the Buyer's purchase of Products from the online store catalog.
3.2. The Seller utilizes the Buyer's personal data for the following purposes:
3.2.1. Identifying the Buyer for order placement and/or contract conclusion for the sale of goods;
3.2.2. Processing and receiving payments from the Buyer;
3.2.3. Delivering goods to the Buyer;
3.2.4. Providing effective customer support to the Buyer;
3.2.5. Offering personalized Services to the Buyer;
3.2.6. Communicating with the Buyer, including sending notifications, requests, and information related to Service usage, service provision, as well as processing Buyer inquiries and applications;
3.2.7. Enhancing Service quality, user-friendliness, and developing new Services;
3.2.8. Notifying the Buyer about ongoing events and promotions;
3.2.9. Conducting statistical and other research based on non-personal data, as well as optimizing advertising messages.
3.3. The Seller bears no responsibility for information provided by the Buyer on the website in a publicly accessible form.
3.4. GHS/Seller is not liable for losses incurred by the Buyer due to third-party access to their login and password.
4. Rights and Responsibilities of the Parties
4.1. The Buyer is obligated to:
4.1.1. Provide information about personal data necessary for utilizing the online store;
4.1.2. Amend or supplement provided information if incorrect data is discovered when using the online store.
4.2. The Buyer has the right to:
4.2.1. Access and modify information about personal data at any time through the web interface provided within the services.
4.3. GHS/Seller is obliged to:
4.3.1. Use the received information solely for the purposes specified in section 3 of this Privacy Policy;
4.3.2. Ensure confidentiality of transferred personal data, refrain from disclosing such data without prior written consent from the Buyer, except for data transfer to fulfill the Buyer’s order (courier services, postal organizations, banks, etc.), and authorized government bodies of the Republic of Kazakhstan in accordance with the legislation of the Republic of Kazakhstan;
4.3.3. Implement measures to safeguard the confidentiality of Buyer's personal data as per the usual procedure used for protecting such information.
4.4. GHS/Seller reserves the right to grant access to the collection and analysis of non-personal data of Buyers to third parties for statistical purposes and optimization of advertising messages. Third-party usage of non-personal data is governed by their respective privacy policies, and the Online Store is not accountable for their usage.
5. Other Terms and Conditions
5.1. By using the online store, the Buyer unconditionally agrees to this Privacy Policy and the terms of processing of the Buyer’s personal data by GHS/Seller. 5.2. If the Buyer disagrees with the terms of the Privacy Policy, they must cease using the Site or online store. 5.3. This Privacy Policy pertains solely to the online store website http://www.tapitap.kz and its subdomains. The online store is not liable for third-party sites accessible to the Buyer through links available on the online store website.
5.4. Due to the nature of data acquisition methods, GHS/Seller does not verify the accuracy of the personal data provided by the Buyer nor monitor its currency. However, GHS/Seller assumes that the Buyer provides accurate and current personal data. The Buyer is responsible for providing accurate and current personal data and bears all liabilities and potential consequences for providing false or outdated personal data.
5.5. Disabling cookies may prevent access to parts of the online store site that require authorization.
5.6. The online store collects statistics on the IP addresses of its Customers, which is utilized for identifying and resolving technical issues and monitoring the legality of financial transactions.
5.7. The current legislation of the Republic of Kazakhstan governs this Privacy Policy and the relationship between the Buyer and GHS/Seller.
5.8. GHS/Seller reserves the right to unilaterally amend this Privacy Policy to enhance the security system in accordance with current legislation of the Republic of Kazakhstan.
